Welcome to Ibile Youth Academy.
These Terms and Conditions ("Terms") govern your access to and use of the Ibile Youth Academy
platform, programs, and services (collectively, the "Platform"). By accessing or using our
Platform, whether as an applicant, fellow, or alumnus, you agree to be bound by these Terms.
Please read these Terms carefully. If you do not agree
with any part of these Terms, you may not access or use the Platform.
1. Definitions
For the purposes of these Terms:
- "Academy" or "We" refers to Ibile Youth Academy and its affiliated
organizations.
- "Applicant" refers to any individual who submits an
application to join the Fellowship Program.
- "Fellow" refers to an individual who has been
selected and accepted into the Fellowship Program.
- "Alumnus/Alumni" refers to individuals who have
successfully completed the Fellowship Program.
- "User" refers to any person who accesses or uses the
Platform, including Applicants, Fellows, and Alumni.
- "Platform" refers to the Ibile Youth Academy
website, portal, applications, and all related services.
- "Content" refers to all text, graphics, images,
videos, data, information, and other materials available on or through the Platform.
2. Eligibility and
Account Registration
2.1 Eligibility Requirements
To use the Platform, you must:
- Be at least 16 years of age (or the age of majority in your jurisdiction)
- Have the legal capacity to enter into binding agreements
- Provide accurate, current, and complete information during registration
- Maintain and promptly update your registration information
2.2 Account Security
You are responsible for:
- Maintaining the confidentiality of your account credentials
- All activities that occur under your account
- Notifying us immediately of any unauthorized use of your account
- Ensuring your account information remains accurate and up-to-date
2.3 Account Restrictions
You may not:
- Create multiple accounts for the same individual
- Share your account credentials with others
- Transfer your account to another person without our written consent
- Use another person's account without permission
3. Application
Process Terms
3.1 Application Submission
By submitting an application, you represent and
warrant that:
- All information provided is true, accurate, and complete
- You meet the eligibility criteria for the Fellowship Program
- You have the right to submit any materials included in your application
- Your application does not violate any third-party rights
3.2 Evaluation and Selection
The Academy reserves the right to:
- Evaluate applications using criteria determined in our sole discretion
- Request additional information or documentation from applicants
- Reject any application for any reason
- Modify selection criteria and processes at any time
- Limit the number of fellows accepted into each cohort
Important Notice: Submission of an application does
not guarantee acceptance into the Fellowship Program. The Academy's selection decisions are
final and not subject to appeal.
3.3 Application Materials
By submitting application materials, you grant the Academy
a non-exclusive, royalty-free license to review, evaluate, and process your application. We may
retain application materials for record-keeping and program improvement purposes.
4. Fellowship
Program Terms
4.1 Program Participation
As a Fellow, you agree to:
- Attend all required sessions, workshops, and activities
- Complete assigned coursework and assessments on time
- Actively participate in program activities and discussions
- Maintain professional conduct at all times
- Comply with the Academy's Code of Conduct
- Respect fellow participants, facilitators, and staff
4.2 Attendance and Performance
Fellows are expected to:
- Maintain a minimum attendance rate as specified by the program
- Meet academic and performance standards
- Communicate absences or challenges to program coordinators
- Complete all required evaluations and feedback forms
4.3 Program Benefits
The Academy provides Fellows with access to:
- Educational content and learning resources
- Mentorship and coaching opportunities
- Networking events and community activities
- Career development support
- Other benefits as described in program materials
No Guarantee of Outcomes: While we strive to provide
high-quality programming, the Academy does not guarantee any specific outcomes, including
but not limited to employment, career advancement, or financial success.
4.4 Fellowship Completion
Fellows who successfully complete all program
requirements will:
- Receive a certificate of completion
- Become eligible for Alumni Network membership
- Gain access to alumni-exclusive benefits and opportunities
4.5 Early Departure
Fellows who leave the program before completion:
- May not receive a certificate of completion
- May not be eligible for alumni benefits
- Must return any Academy property or resources
5. Alumni Network
Terms
5.1 Alumni Membership
Alumni status is granted to individuals who have
successfully completed the Fellowship Program. Alumni members gain access to:
- The Alumni Network platform and directory
- Continuing education and professional development opportunities
- Networking events and community activities
- Mentorship opportunities (as mentor or mentee)
- Job and opportunity postings
5.2 Alumni Responsibilities
As an Alumnus, you agree to:
- Maintain accurate profile information
- Use the Alumni Network professionally and respectfully
- Respect the privacy of other alumni
- Comply with the Academy's Code of Conduct
- Support the Academy's mission and values
5.3 Alumni Communications
The Academy may communicate with alumni through:
- Email newsletters and announcements
- Platform notifications
- Event invitations
- Surveys and feedback requests
Alumni may opt out of non-essential communications at
any time through their account settings.
5.4 Opportunities and Postings
The Academy may share job postings and opportunities
with alumni. However:
- We do not guarantee the accuracy or legitimacy of third-party postings
- We are not responsible for interactions between alumni and third parties
- Alumni engage with opportunities at their own risk
6. User Conduct
and Responsibilities
6.1 Acceptable Use
You agree to use the Platform only for lawful
purposes and in accordance with these Terms. You agree NOT to:
- Violate any applicable laws or regulations
- Infringe upon the rights of others
- Harass, abuse, threaten, or intimidate other users
- Post false, misleading, or fraudulent information
- Impersonate any person or entity
- Engage in spam or unsolicited advertising
- Upload viruses, malware, or other harmful code
- Attempt to gain unauthorized access to the Platform
- Interfere with the proper functioning of the Platform
- Scrape, data mine, or harvest user information
6.2 Content Standards
Any content you submit or share must:
- Be accurate and truthful
- Not violate copyright, trademark, or other intellectual property rights
- Not contain offensive, discriminatory, or hateful material
- Not contain confidential or private information about others
- Comply with all applicable laws and regulations
6.3 Reporting Violations
If you become aware of any violation of these Terms,
please report it to us immediately at [email protected].
7. Privacy and
Data Protection
7.1 Data Collection
We collect and process personal information as
described in our Privacy Policy. By using the Platform, you consent to our collection, use, and
disclosure of your information in accordance with these Terms and our Privacy Policy.
7.2 Information We Collect
We may collect:
- Personal identification information (name, email, phone, address)
- Demographic information (age, gender, location)
- Educational and professional background
- Application materials and assessments
- Program participation and performance data
- Usage data and analytics
7.3 How We Use Your Information
We use your information to:
- Process and evaluate applications
- Administer the Fellowship Program and Alumni Network
- Communicate with you about programs and opportunities
- Improve our programs and services
- Comply with legal obligations
- Conduct research and analysis (in aggregated, anonymized form)
7.4 Data Security
We implement reasonable security measures to protect
your personal information. However, no method of transmission or storage is 100% secure, and we
cannot guarantee absolute security.
7.5 Your Rights
You have the right to:
- Access your personal information
- Correct inaccurate information
- Request deletion of your information (subject to legal requirements)
- Opt out of certain communications
- Withdraw consent (where applicable)
8. Intellectual
Property Rights
8.1 Academy Content
All Content available on the Platform, including but
not limited to text, graphics, logos, images, videos, audio, software, and course materials, is
the property of Ibile Youth Academy or its licensors and is protected by copyright, trademark,
and other intellectual property laws.
8.2 Limited License
We grant you a limited, non-exclusive,
non-transferable license to access and use the Platform and its Content solely for your
personal, non-commercial use in connection with the programs. You may not:
- Copy, modify, or distribute Content without authorization
- Use Content for commercial purposes
- Remove copyright or proprietary notices
- Create derivative works based on our Content
8.3 User-Generated Content
By submitting content to the Platform (comments,
posts, projects, etc.), you grant the Academy a worldwide, royalty-free, perpetual, irrevocable
license to use, reproduce, modify, publish, and distribute such content for the purposes of
operating the Platform and promoting our programs.
8.4 Feedback
If you provide feedback, suggestions, or ideas about the
Platform or programs, the Academy may use such feedback without any obligation to you.
9. Disclaimers and
Warranties
9.1 "As Is" Basis
The platform and all content are provided
"as is" and "as available" without warranties of any kind, either express or implied, including
but not limited to implied warranties of merchantability, fitness for a particular purpose, or
non-infringement.
9.2 No Guarantee of Outcomes
The Academy does not warrant or guarantee:
- That the Platform will be uninterrupted, secure, or error-free
- That defects will be corrected
- That the Platform is free of viruses or harmful components
- The accuracy, reliability, or completeness of any Content
- Any specific results from program participation
9.3 Third-Party Content
The Platform may contain links to third-party
websites or services. We are not responsible for the content, accuracy, or practices of
third-party sites. Your use of third-party sites is at your own risk.
9.4 No Professional Advice
Content on the Platform is for informational and
educational purposes only and does not constitute professional, legal, financial, or career
advice. You should consult appropriate professionals for specific advice.
10. Limitation of
Liability
10.1 Exclusion of Damages
To the fullest extent permitted by law,
Ibile Youth Academy, its officers, directors, employees, partners, and affiliates shall not be
liable for:
- Any indirect, incidental, special, consequential, or punitive damages
- Loss of profits, revenue, data, or use
- Loss of opportunities or business relationships
- Personal injury or property damage
- Any damages arising from your use or inability to use the Platform
10.2 Maximum Liability
In no event shall our total liability to you for all
claims exceed the amount you paid to access the Platform (if any) in the twelve (12) months
preceding the claim, or ₦100,000 (One Hundred Thousand Naira), whichever is less.
10.3 Jurisdictional Limitations
Some jurisdictions do not allow the exclusion or
limitation of certain warranties or liabilities. In such jurisdictions, our liability shall be
limited to the maximum extent permitted by law.
11. Termination
and Suspension
11.1 Termination by You
You may terminate your account at any time by
contacting us at [email protected]. Fellows who wish to
withdraw from the program must follow the program's withdrawal procedures.
11.2 Termination by Academy
We reserve the right to suspend or terminate your
access to the Platform at any time, with or without notice, for any reason, including but not
limited to:
- Violation of these Terms
- Fraudulent or illegal activity
- Failure to meet program requirements (for Fellows)
- Conduct detrimental to the Academy or other users
- Extended period of inactivity
11.3 Effects of Termination
Upon termination:
- Your right to access the Platform will immediately cease
- We may delete your account and data (subject to legal retention requirements)
- You must cease all use of the Platform and any downloaded Content
- Sections of these Terms that by their nature should survive termination shall survive
12. Modifications
to Terms
We reserve the right to modify these Terms at any
time. When we make material changes, we will:
- Update the "Last Updated" date at the top of these Terms
- Notify you through the Platform, email, or other communication methods
- Provide a reasonable notice period before changes take effect
Your continued use of the Platform after the
effective date of any changes constitutes your acceptance of the modified Terms. If you do not
agree to the changes, you must stop using the Platform and may terminate your account.
Stay Informed: We encourage you to review these Terms
periodically to stay informed about your rights and obligations.
13. Governing Law
and Dispute Resolution
13.1 Governing Law
These Terms shall be governed by and construed in
accordance with the laws of the Federal Republic of Nigeria, without regard to its conflict of
law provisions.
13.2 Jurisdiction
You agree that any legal action or proceeding arising
out of or relating to these Terms or the Platform shall be brought exclusively in the courts
located in Lagos State, Nigeria, and you consent to the personal jurisdiction of such courts.
13.3 Dispute Resolution Process
In the event of any dispute, controversy, or claim
arising out of or relating to these Terms:
- Informal Resolution: You agree to first contact us
at [email protected] to attempt to
resolve the dispute informally.
- Mediation: If informal resolution fails, the parties
agree to attempt to resolve the dispute through mediation before pursuing litigation.
- Litigation: If mediation fails, either party may
pursue legal action in accordance with Section 13.2.
13.4 Waiver of Class Actions
You agree that any dispute resolution proceedings will be
conducted on an individual basis and not as a class, consolidated, or representative action.
14. General
Provisions
14.1 Entire Agreement
These Terms, together with our Privacy Policy,
constitute the entire agreement between you and the Academy regarding the Platform and supersede
all prior agreements and understandings.
14.2 Severability
If any provision of these Terms is found to be
invalid or unenforceable, the remaining provisions shall remain in full force and effect.
14.3 Waiver
Our failure to enforce any right or provision of
these Terms shall not constitute a waiver of such right or provision.
14.4 Assignment
You may not assign or transfer these Terms or your
rights hereunder without our prior written consent. We may assign these Terms without
restriction.
14.5 Force Majeure
The Academy shall not be liable for any failure or
delay in performance due to circumstances beyond our reasonable control, including but not
limited to acts of God, war, terrorism, civil unrest, government actions, labor disputes, or
technical failures.
14.6 Language
These Terms are written in English. In the event of any
conflict between an English version and a translation, the English version shall prevail.
Acknowledgment
By using the Ibile Youth Academy Platform, you
acknowledge that you have read, understood, and agree to be bound by these Terms and Conditions.
